We are looking for an experienced Enterprise Business Development Representative with a vision for how to build an outbound sales function and a bias for action. As we newly embark on creating this outbound prospecting and lead development arm of Brilliant, you will be responsible for first stepping into the newly created role of outbound BD (or Business Development) and honing it, creating a repeatable process, and working closely with the existing BD team to generate opportunities within Enterprise prospects, and customers.

You will sell Brilliant’s corporate gifting and branded merch platform to companies of all sizes, from 200 employee startups to 10,000 person global corporations. Within every organization, there are typically 5-7 buying centers who can benefit from working with Brilliant Brilliant. We support employees who own gifting in HR, Sales, Marketing, Brand, Procurement and more (there are so many fish in the sea!). This role will be a blend of prospecting into existing Enterprise customers and net new prospects. For new prospects, you will be responsible for generating opportunities and working closely with our Enterprise BD leader to move deals through the pipeline.

In this role, you will:

  • Help to define and monitor the necessary inputs to achieve targets for the BDA team
  • Identify potential market opportunities, develop target prospecting account lists, and work with lead generation partners to build prospect lists, run initial warming campaigns
  • Generate and qualify leads through various channels, including cold calling, email campaigns, events, and subcontracted lead generation services
  • Keep the pipeline full of qualified prospects and convert those prospects into handoffs
  • Create and execute plans to nurture leads that are not ready to purchase and re-engage leads that were previously warm

Important points of collaboration:

  • With our Enterprise BD Director to prioritize the highest value prospects and collaborate on a plan of attack
  • With our VP of Sales to build a repeatable process so we can intelligently grow this team
  • With our Marketing team to develop compelling prospecting and lead engagement presentations and to inform and support prospecting efforts from Marketing
  • With our Client Services team to ensure successful project handoffs that convert to revenue and satisfied clients
  • With our Product team to to fully understand our platform offerings to help determine who to prospect and what information will be more compelling to those audiences

About you:

  • You have 2-5+ years of experience in B2B sales, with a proven track record of success
  • You have experience proactively prospecting into large organizations
  • You are comfortable with ambiguity and adapting to process that changes as progress is measured
  • You’re willing – nay, eager! – to get your hands dirty at first (no job too small!) until you can justify scaling your team by delivering results
  • You are focused maniacally on selling – your main passion is pursuing revenue, not org-building
  • You’re an xperienced user of growth technology (SFDC systems, productivity tools and marketing automation tools)

Experience: 2-5+ years experience working with a B2B sales organization

Education Required: Bachelor’s from an accredited college or university

Base: $70,000 + $30,000 incentive comp (starting incentive comp expected for hitting quotas)

Role

Each Lead is pivotal in developing, delivering, maintaining, and supporting our insurance systems, both public and internal. Responsibilities:

  • Alongside the Product owner you’ll be responsible for setting the technical and product direction of your team, setting realistic timelines, identifying risks and ensuring the project goals and deliverables are correctly implemented.

The Opportunity: 

The Legal department is looking for the next addition to our legal team -- a great lawyer who will manage our IP portfolio and various technology policies (e.g. open source) and work closely with technology teams on any expansion of our IP; advise various product and technology teams on AI, use of data and data governance; and review, draft and negotiate SaaS agreements with vendors and strategic partners. 

As IP & Product Commercial Counsel, you’ll join a global team and report directly to the Chief Legal Officer. You will partner directly with executives and senior business and technology leaders on the maintenance and growth of our global supply chain technology platform and our IP portfolio. 

This role is a great opportunity for someone with a passion for technology, excellent problem-solving skills and an ability to thrive in a fast-paced, changing environment that requires cross-functional collaboration across the legal, technology and business teams. 

You Will: 

Manage the Company’s IP Portfolio:

  • Manage and maintain an ever-expanding global trademark portfolio along with outse counsel 
  • Lead internal invention harvesting/brainstorming activities with technology team members 
  • Manage patent preparation, prosecution, and related activities carried-out by outside counsel 
  • Review draft patent applications, office actions and other patent office submissions 
  • Conduct training related to patents 
  • Support IP-related aspects of M&A and strategic transactions 
  • Analyze any potential third party infringement, cease & desist notifications and any IP-related disputes 

Lead Commercial Contracts for SaaS & Technology Partners 

  • Negotiate SaaS contracts with a variety of third parties including vendors in the cutting edge technology areas of supply chain visibility. customers and vendors (G&A) across all industries, segments and geographic locations. 
  • Support and coach product, engineering and operations teams on the most critical IP and data-related commercial issues in SaaS contracts and deals. 

Provide Product Counsel to Various Business & Technology Teams:

  • Work with various product and engineering teams on AI-related initiatives, data integrations with various third parties and data governance policies and procedures. 
  • Serve as a trusted advisor and business partner across the Company by providing counsel and guidance for accomplishing Flexport’s overall business objectives.

Negotiate Commercial Contracts for the US Business: 

  • Negotiate commercial contracts of all types with various types of vendors (non-SaaS, G&A, various commercial) 
  • Advise a multitude of business teams on risk, negotiating points, and agreement structures. 
  • Collaborate with leadership in Sales, Finance, Risk, Insurance, Compliance, Operations, and various business teams across the Company to close deals. 

You Should Have: 

  • JD and bar admission to practice in any US state. 
  • 4 + years of professional experience including private law firm experience and/or in-house. 
  • Experience in intellectual property, whether at a law firm or in house. 
  • A solid understanding of commercial contract law. 
  • Experience and/or the willingness to learn how to review cutting-edge platform products and services that implicate data sharing, data rights, data use, AI, and data integrations between Flexport and various third parties
  • Experience and/or desire to partner with a dynamic product & engineering team across the Company 
  • Desire to expand to support additional business teams as required by Company growth.
  • Practical experience and solid knowledge of commercial and contract law. 
  • Comfort with handling topics such as privacy and data protection in the commercial contract context. 
  • The ability to multitask, work on your own, and prioritize multiple, often competing for deliverables while managing expectations meeting deadlines. 
  • Outstanding interpersonal skills and the ability to coordinate effectively and gain trust and confidence with personnel at many different levels. 
  • Ability to work as a team member of the legal department in a scalable, autonomous and accountable manner, demonstrating flexibility across deal types and time zones. 
  • Excellent communication skills to interact with both internal departments and external business clients while addressing complex issues in an accurate, clear, and thorough manner.

You Will: 

Lead Litigation Strategy for Commercial Disputes: 

  • Be the lead legal advisor to the business, Chief Legal Officer and Chief Financial Officer on all commercial disputes, both pre-litigation matters and formal litigation
  • Represent the Company in a variety of venues, including mediation, arbitration, private settlements, regulatory bodies and US courts 
  • Lead engagements with various outside counsel as necessary 
  • Work with litigation paralegal to manage and track all matters, from inception and preservation notices through interim reporting of matters and accruals, through to resolution of matters 

You Should Have: 

  • 3+ years of experience in commercial litigation, resolving pre-litigation commercial disputes of all types 
  • Knowledge and experience in commercial disputes within the supply chain a very strong plus — transportation, trucking, warehousing, freight forwarding, ocean carrier, motor carrier, air carriers 
  • Knowledge of general conventions and liability standards (COGSA, Warsaw, Montreal, etc) applicable to logistics and cargo claims and disputes a very strong plus
  • A strong preference for applicants with litigation experience or experience handling pre-litigation claims and disputes in the maritime or trucking industry. 
  • Command of federal and state laws and regulations governing trucking, property brokerage, warehousing, 3PL services, carrier liens, and financial transactions in the transportation industry. 
  • A strong appreciation of how transportation services are actually performed that empowers you to provide clear, actionable legal advice about operations and strategic plans. 
  • A working knowledge of marine, cargo, logistics and liability insurance is a strong plus.

You will partner directly with executives and senior business leaders on innovative technology-forward solutions to disrupt the US trucking industry, negotiate commercial contracts with various participants in the trucking and warehousing supply chain and ensure the Company’s compliance with applicable legal and compliance obligations.

You Will: 

Lead Product Review for Innovative Trucking, Warehousing and Fulfillment Platforms:

  • Be the lead legal advisor to the Product & Engineering teams in charge of our trucking brokerage platform application for both brokers and motor carrier users, including for compliance with all applicable laws and regulations and ensuring terms and conditions applicable to the use of the platform and the relationship with Flexport are clearly outlined between all parties.
  • Review iterations to our current fulfillment product platform in which companies of all sizes (but in particular SMB enterprises) coordinate the last-mile delivery of their cargo within the United States 

Lead Commercial Contracts with Trucking & Warehousing Providers: 

  • Draft, review, and negotiate commercial contracts in the US and internationally, including terms of service, warehousing and fulfillment agreements, carrier, broker and transportation agreements, agreements with shippers, partnership agreements, and procurement agreements 
  • Coordinate and collaborate with various teams such as Product, Engineering, Sales, 3PL Operations, and Procurement to collect input, ensuring our agreements appropriately reflect business needs. 
  • Advise, support and coach the business on risk, negotiating points and agreement structures in various supply chain agreements 
  • Serve as a trusted advisor and business partner across the company by providing counsel and guidance for accomplishing Flexport’s overall business objectives 

You Should Have: 

  • 8+ years of experience representing companies in the transportation industry including trucking (asset operating carriers and/or property brokers), warehousing, and/or fulfillment 
  • Experience negotiating various supply chain transportation service agreements (motor carriers, brokers, warehouses and 3PL providers). 
  • A strong preference for applicants with litigation experience or experience handling pre-litigation claims and disputes in the trucking industry. 
  • Command of federal and state laws and regulations governing trucking, property brokerage, warehousing, 3PL services, carrier liens, and financial transactions in the transportation industry. 
  • A strong appreciation of how transportation services are actually performed that empowers you to provide clear, actionable legal advice about operations and strategic plans.
