Job Description

The Senior Privacy, Compliance and Regulatory Counsel is the Company’s chief legal counsel responsible for advising the company’s C-level executives and business teams on a wide variety of legal and regulatory matters, including privacy, compliance, and federal and state regulation. As Senior Privacy, Compliance and Regulatory Counsel, you will report directly to the Chief Compliance Officer. You will serve as a key member of the privacy and compliance teams to help develop and execute on strategies and programs to help ensure the company’s compliance with applicable laws and regulations. The position represents Brightspeed before the FCC, FTC, and state PUCs, and serves as a trusted legal advisor to all parts of the business on privacy, compliance, and regulatory matters. You will collaborate effectively with colleagues within the legal department and across the company to ensure that legal and regulatory risks are understood, communicated, and mitigated effectively. You will be required to have seasoned judgment and a demonstrated ability to manage complex and novel issues across federal and state legal and regulatory landscapes.

As Senior Privacy, Compliance and Regulatory Counsel, your duties will include:

  • Worksclosely with Brightspeed’s Chief Privacy Officer (CPO), Chief Compliance Officer, Chief Information Security Officer (CISO) to provide legal support for the company’s overall privacy, corporate, and cybersecurity compliance programs
  • Develop, draft, and represent Brightspeed on regulatory, legislative, and public policy matters before the FCC, FTC, and state public utility commissions
  • Support the CPO in conducting reviews of the company’s privacy program to ensure it reflects changes in laws, regulatory, and company policy
  • Provide advice and counsel to senior leadership and internal clients on privacy and IT security matters affecting the company
  • Ensure Brightspeed’s data and privacy programs and projects operate in a manner consistent with applicable law and company privacy and data security goals and policies
  • Develop and oversee a risk management and compliance framework for privacy and corporate compliance that meets or exceeds industry practices and standards
  • Interact with key stakeholders inside and outside the company on privacy and governance, risk, and compliance (GRC) policies, enforcement, and advocacy
  • Interact regularly with in-house regulatory and compliance teams and outside counsel
  • Proactively identify and mitigate areas of risk or reputational damage in the privacy, GRC, and regulatory areas
  • Help plan, develop, and communicate key messages and initiatives to government stakeholders across the FCC, the Administration, and state PUCs
  • Interact with outside counsel, consultancies, and industry groups to develop and implement business and regulatory strategies
  • Monitor FCC rulemakings, rules, and pertinent telecom and privacy laws and regulations and keeps company management apprised of important developments
  • Draft executive summaries for company leadership.
  • Advise business, product, transactional, and marketing teams on the application of federal and state privacy law and regulation to business operations
  • Support company efforts to obtain and maintain regulatory licenses and authorizations and ensures ongoing regulatory compliance
  • Stay informed about industry legislative, regulatory, policy, and political changes to help ensure appropriate risk management or mitigation strategies are maintained

 

 

 

Qualifications

You’re analytical, detail-oriented, and great at quickly applying your legal expertise and business acumen to solve challenging problems while exercising solid judgment processes.
  • JD degree and ten (10) or more years of relevant work experience
  • 4+ of legal experience with a law firm and/or in-house
  • FCC or FTC legal or staff experience or experience interacting with the FCC, FTC and/or state PUCs is preferred
  • Privacy certifications (e.g., CHPS, CIPP/US, CIPM, etc.) are a plus
  • Experience in the wireline communications industry
  • Strong written and verbal skills
  • Demonstrated ability to interact effectively with all levels of personnel and to describe and enforce legal requirements
  • Bar membership and needed licenses

Job Description

We are currently looking for a Senior Manager, Indirect Tax to join our Finance team. As Senior Manager, Indirect Tax, you will report directly to the Director, Tax. You will drive the Company’s indirect tax planning process and compliance cycle for all state and local jurisdictions including sales & use tax, property tax and relevant transaction taxes supported by third-party outsource firms. You will ensure the accurate and timely filing of all US transaction tax returns.  You will provide strategic leadership with respect to sales & use, and property tax audits, assessing the taxability or available exemptions to complex customer and supplier matters, and advising the business on indirect tax matters to enable effective decision making relating to new product offerings and system requirements.  

As Senior Manager, Indirect Tax, your duties will include:

  • Key indirect tax point of contact for the Brightspeed companies
  • Drive the Company's indirect tax planning process and compliance cycle for all state and local jurisdictions including communications taxes/fees/surcharges (e.g., telecom taxes, FUSF, etc.), sales & use tax, property tax, business license and other relevant transaction taxes with the support of third-party outsource firms as needed
  • Ensure the accurate and timely filing of all US transaction tax returns
  • Lead the telecommunication transaction tax exemption process
  • Work with AR, AP, and IT to resolve any billing discrepancies
  • Work with Product Development and Sales Org/Distribution Channel teams to review new products or product changes in order to assign the proper service/material coding for purposes of mapping to the tax engine 
  • Prepare monthly account reconciliation for sales tax payable account, responsible for reconciliation of sales & use tax accrual accounts to tax returns and payments to support the accruals for each state
  • Prepare account reconciliations for property tax payable account
  • Monitor business and legislative changes in applicable areas to determine the impact to Brightspeed
  • Review processes, building out a controls framework and risk policies suitable for Brightspeed with a continuous improvement mindset seeking out innovative solutions
  • Document and monitor indirect tax risk/management policies and procedures
  • Manage all US indirect tax audits, including negotiation and strategy
  • Work cross functionally with finance and other departments to support the accounting close process, advising on tax accounting and indirect tax matters as new developments arise
  • Assist with special projects, as directed

 

 

Qualifications

WHAT IT TAKES TO CATCH OUR EYE:

  • Bachelor’s degree in Taxation or related field is preferred.  CPA is preferred.
  • 8+ years of experience with US indirect taxes, including experience with technology, e-commerce and telecommunications transaction taxes including Federal & State Universal Service Fund (FUSF), Emergency 911 (E911), Public Utility Commission Fees/Gross Receipts Tax (PUC), Federal Excise Tax (FET) and similar fees.
  • Prior Big 4 public accounting experience as well as industry experience strongly preferred
  • Detailed knowledge of sales & use tax laws, regulations, state controversy work and best practices relating to invoice requirements
  • Proficient using Vertex
  • Experience using data analytics software and running SQL queries in SAP is a plus
  • Excellent interpersonal and communication skills with the proven ability to interface across all levels of Brightspeed including executive leadership, managers and individual contributors
  • Strong attention to detail and outstanding organization skills
  • A proven ability to independently manage multiple priorities and meet tight filing deadlines
  • Strong Excel skills and MS Office proficiency

We are currently looking for an IT Analyst, Financial Systems to join our growing IT Finance Team! As IT Analyst, Financial Systems will support the IT Manager, Financial Systems in the development, implementation, and administration of the organization's financial systems. Brightspeed is currently looking for an IT Systems Analyst to join our growing HR Technology team! In this role, you will report directly to the IT Manager of HR Technology. You will perform a variety of duties to support the business HR systems and process improvements, including software setup, user training and user support. You will work as a liaison among stakeholders to elicit, analyze and validate requirements for changes to business processes and systems. We are currently looking for an exceptional Senior Manager, Tax Operations to join our growing Finance Team. As Senior Manager, Tax Operations, you will report directly to the Director, Tax. You will have over 8 years of experience and a strong background in the accounting for income taxes (ASC740), federal taxation of U.S. corporations and consolidated groups, with general knowledge of partnership taxation and multistate income and franchise taxation. You will be familiar with the standard concepts, practices and procedures of a telecommunications/regulated U.S. Company. You will manage several professional accounting firms that provide compliance, tax advice and/or offer tax planning strategies to lower the Company’s effective tax rate and cash taxes. You will rely on experience and judgment to plan and accomplish goals. 

As Senior Manager, Tax Operations, your job duties and responsibilities will include:

  • Prepare and review tax provision calculations for monthly, quarterly and annual reporting
  • Prepare ASC 740 related disclosures for quarterly and annual reporting
  • Oversee and coordinate the relationship with vendors in connection with the preparation, review and timely filing of the Company’ US federal, state and local income and franchise tax, extensions and estimates in a paperless environment.
  • Establish and maintain strong relationships with our external partners

As Program Manager, you will establish the NOC/SOC PMO: and determine appropriate project management practices, tools, and documentation in order to successfully support the Network Operations and Security Operations Centers. We have an exciting opportunity for a Solution Architect, Order Fulfillment to architect E2E system solutions for the Brightspeed telecom suite of applications. As a key leader on our IT team, you will be responsible for system solutions in the areas of order fulfillment orchestration, inventory, provisioning, and billing domains. You you will be a subject matter expert in design, development, and maintenance of LAN/WAN network services responsibilities. We are currently looking for an IT Manager, Financial Systems to join our growing IT Finance Team! As IT Manager, Financial Systems, you will support the Director, Financial Systems in the development, implementation, and administration of the organization's financial systems. You will research requirements and liaise across the company to ensure that systems are modified to meet the most recent business requirements, processes and reporting standards, as well as the needs of key business leadership and finance colleagues. Functional accountability includes supporting the finance business units from financial systems standpoint. You will establish best practices for financial systems use and ensure these practices are used throughout the organization. As IT Manager, Financial Systems, your duties will include:

  • Work closely with business leaders, process champions, implementation partners and cross-functional teams to design, build, test and implement comprehensive and efficient financial platforms, systems and processes
  • Monitor, control, analyze, evaluate, and recommend further adaptation or modifications of financial system that will assist the company to achieve the efficiencies and productivity increases
  • Responsible for providing support for billing, contracts and revenue recognition processes.
  • Responsible for providing support for vendor invoice management, vendor payments and banking processes. 
  • Support external and internal reporting and analysis needs of the business, ensuring compliance with corporate deadlines and requirements.
  • Track and report on key performance indicators (KPIs) focused on current and future performance.
